A consumer is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity. The following regulations apply both to written direct orders to ABEG and to orders through requests for offers via the ABEG website or other Internet platforms such as Ebay, Amazon or similar. The buyer's requests for offers via the Internet are non-binding. A legally binding purchase contract is only concluded in accordance with the provisions of these General Terms and Conditions upon acceptance of the subsequent written offer from ABEG. There is no online sale via the Internet. The legal cancellation regulations set out there do not apply to the sale of the goods listed under "2. Subject of the contract".

2. Subject matter of the contract
The subject of the respective contract is the sale of goods by ABEG to the buyer. On the Internet or in ABEG's sales documents, the goods are presented as non-binding offers by ABEG to conclude a purchase contract for the respective item.

4. Conclusion of contract
After receiving ABEG’s offer, the buyer can order goods by telephone or in writing, including by email to the address “info@abeg.de”. The subsequent written order confirmation from ABEG constitutes a legally binding purchase contract.

5. Time of dispatch
Depending on the quantity and type, we ship our goods ourselves, with a parcel service or via a forwarding agent. Delivery is carried out promptly within Germany and can usually be tracked online. Should there be delays due to adverse circumstances, we can inform you if you have given us your telephone number and email address when placing your order. We cannot accept liability for delays.

6. Storage of data
Your order and the order data you enter are saved to process the quote request and the order. If you have created a personal customer account, the data is saved there. You can access your customer account at any time using your login data, which you choose when you first register. A quote request can also be created and sent to ABEG without creating a customer account. You will receive the order confirmation with all the data you entered by email to the email address you entered for the quote request. After receiving the goods, Abeg sends the customer a message asking them to rate the product and the processing of the sale. The customer agrees that this rating will be published on the provider’s website.

7. Links, banners, guestbook:
We cannot check the accuracy and completeness of the information on the pages that can be reached via links or banners from this site. The operators of the linked pages are solely responsible for their content. We declare that we have no influence on the design and content of third-party pages. If you write a post on the blog, please refrain from making any statements that violate the law or otherwise infringe the rights of third parties. 8. Warranty, Guarantee, Liability
ABEG's warranty in the event of a defect in the goods and the seller's liability for damages are governed by the statutory provisions. The warranty period for the radio control electronics installed therein or delivered separately is 2 years from the delivery date.

Guarantee: A 10-year guarantee is provided for the infrared heating elements produced by the manufacturer ABEG Anlagen GmbH. The period for calculating the guarantee period begins on the invoice date. The geographical scope of the guarantee protection is the EU. The guarantee refers to the freedom from defects of the advertised product, including functionality. Should a defect occur during the guarantee period, the manufacturer will provide one of the following services of its choice within the scope of this guarantee:

▪ free repair of the goods or
▪ free exchange of the goods for an equivalent item

Warranty claims are excluded in the case of:
• normal wear and tear
• improper handling and use (e.g. cutting off the plug)
• incorrect assembly or commissioning
• transport damage must be reported immediately to the manufacturer, dealer or (in the case of typical transport damage) directly to the transport company.
• unauthorized modifications and changes to the device.
• chemical, electrochemical or electrical influences (e.g. overvoltage).
• disasters caused by external influences or force majeure.
• failure to observe safety precautions
• use of force (e.g. blows)
• attempts to repair on your own

The prerequisite for claiming the guarantee is that the guarantor is given the opportunity to examine the guarantee case (e.g. by sending the goods in/guarantor free delivery). Care must be taken to avoid damage to the goods during transport by using secure packaging. When applying for the guarantee, a copy of the invoice must be enclosed with the shipment of goods so that the guarantor can check whether the guarantee period has been met. Without a copy of the invoice, the guarantor can refuse to provide the guarantee. If the guarantee claims are justified, you will not incur any shipping costs, i.e. the guarantor will reimburse any shipping costs for the outward shipment. This manufacturer's guarantee does not limit your legal rights against ABEG arising from the concluded purchase contract. This guarantee promise does not affect any existing legal warranty rights against us. The manufacturer's guarantee does not violate your legal rights, but rather extends your legal position. If the purchased item is defective, you can always contact us within the scope of the legal warranty, regardless of whether a guarantee case exists or the guarantee is invoked.

9. Payment
Payment for the goods, including the shipping costs mentioned, must be made before delivery. Deliveries abroad are made against advance payment by bank transfer via IBAN and BIC:

The delivered goods remain the property of ABEG Anlagen GmbH until full payment has been made. Transfer of ownership by way of security or pledging is excluded. All prices are in euros and include the applicable sales tax.

10. Warnings
In the event of any legal violations in the content or blog of this website (e.g. copyright infringements), we request that you contact us in advance to avoid unnecessary legal disputes and costs in order to resolve the disagreements as amicably and informally as possible. The cost of a legal warning will therefore be rejected as unfounded in the sense of the obligation to mitigate damages if we were not contacted beforehand and informed of any grievances. These General Terms and Conditions and the purchase contract concluded by accepting the written offer from ABEG are subject exclusively to German law, excluding the UN Convention on Contracts for the International Sale of Goods. In the event that the buyer is a consumer, this only applies insofar as the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his habitual residence. Should one or more clauses of these Terms and Conditions be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
